PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING OUR SERVICES. BY ACCESSING, BROWSING, OR USING ANY PART OF FLOW AI FX, YOU EXPRESSLY AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL THE PROVISIONS OF THESE TERMS, YOU MAY NOT ACCESS THE WEBSITE OR UTILIZE ANY OF OUR SERVICES.

To access and use our Services, you must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction. You represent and warrant that you possess full legal capacity to enter into these Terms.

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether an individual or legal entity, referred to as "you" or "your") and Flow AI Fx ("we", "us", or "our"), governing your access to the website located at flowaifx.app ("Website") and the hosted AI-powered software, APIs, and creative applications (collectively, the "Services").

If you are accessing or using our Services on behalf of a company, organization, or other legal entity (an "Organization"), then: (a) these Terms constitute an agreement between us, you personally, and that Organization; and (b) you represent and warrant that you have full authorization and authority to bind that Organization to these Terms.

1. Right to Access and Use Our Services

Flow AI Fx grants you a limited, worldwide, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and utilize the Services for the purpose of creating AI-generated videos, photorealistic images, dynamic music, and expressive voiceovers using platform-hosted and third-party AI models.

You shall not:

Distribute, lease, rent, sublicense, assign, or commercially resell access to the Services or API endpoints without our prior written authorization;
Reverse engineer, decompile, disassemble, or attempt to decipher the source code, internal model weights, or proprietary algorithms underlying the Services;
Circumvent or attempt to tamper with security measures, rate limits, or credit metering mechanisms;
Perform automated scraping, data extraction, or systematic crawling of platform resources beyond what is explicitly permitted via authorized platform features.

2. Your Flow AI Fx Account

To access most features of the Services, you must register for an account using verified authentication methods (such as Google OAuth or verified email). You agree to provide accurate, current, and complete information and to keep your credentials updated.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities, tasks, and credit expenditures incurred under your account. You agree to notify Flow AI Fx immediately at support@flowaifx.app if you discover or suspect any unauthorized access or security incident. Flow AI Fx is not liable for any losses or damages resulting from unauthorized account activity caused by your failure to protect your login credentials.

3. Acceptable Use Policy, User Reporting, and Content Governance

You agree to use the Services strictly for legitimate, lawful, and authorized creative purposes. You bear sole responsibility for your actions, the materials you upload, and how you use generated outputs, complying with all applicable local, national, and international laws and regulations.

Prohibited Activities and Content

You explicitly agree not to use the Services or any user-uploaded or generated content to:

Child Exploitation: Create, upload, process, or disseminate Child Sexual Abuse Material (CSAM), content depicting or sexualizing minors, or content that exploits children in any manner.
Non-Consensual & Prohibited NSFW Content: Generate or distribute non-consensual explicit sexual imagery, pornography, deepfake sexual depictions, graphic gore, extreme violence, or unauthorized sexualized content.
Intellectual Property Infringement: Upload reference media or produce outputs that infringe, misappropriate, or violate third-party copyrights, trademarks, publicity rights, trade secrets, or patents.
Deceptive Impersonation & Malicious Deepfakes: Create media or voice clones designed to fraudulently impersonate living individuals, government officials, or public figures without verified authorization, or generate deceptive media aimed at spreading disinformation, unauthorized face-swaps, or intimate scene forgery.
Hate Speech & Harassment: Generate content that promotes violence, incites hatred, discriminates against protected groups, or engages in harassment, stalking, or defamation against any individual or group.
Malicious Exploitation & Infrastructure Attacks: Introduce malware, viruses, or destructive code, utilize adversarial jailbreak prompts to bypass safety filters, disrupt platform performance, overload GPU/server clusters, or interfere with other users' enjoyment of the platform.

User Reporting Channel

To mitigate AIGC compliance risks and maintain a safe platform environment, Flow AI Fx provides a dedicated reporting channel for safety violations and rights infringement:

Dedicated Report Email: report@flowaifx.app
Scope & Details: You may report any generated content that violates these terms, infringes your intellectual property, or uses your likeness/voice for unauthorized deepfakes. Please include the relevant URL, Task ID, or screenshot evidence to assist our investigation. Reporter identities are kept strictly confidential.

Investigation and Enforcement Actions

We employ automated safety filters and human moderation to inspect prompts, inputs, and outputs. Upon receiving a user report, we enforce a closed-loop content governance workflow:

Review & Triage: Incoming reports are reviewed by our moderation team, with evidence verification typically initiated within 24 to 48 hours.
Graded Enforcement Measures: If a violation is substantiated, Flow AI Fx reserves the right, without prior notice or liability, to:
- Takedown, hide, or permanently delete violating assets from cloud storage and CDN caches;
- Forfeit and decline to refund any credits or subscription fees associated with prohibited requests;
- Restrict specific features, temporarily suspend, or permanently terminate the violating account;
- Proactively report criminal conduct (such as CSAM or cyber threats) to relevant law enforcement and regulatory authorities.
Closed-Loop Resolution: Upon completing enforcement, our team notifies the reporter with the outcome, maintaining a complete content management loop.

4. Ownership of Content and Intellectual Property

A. Your Ownership

As between Flow AI Fx and you, you retain all right, title, and interest in and to:

Your Input Content: The prompts, reference images, source video clips, audio tracks, and voice samples you provide to the Services; and
Your Generated Content: The final AI-generated videos, images, music compositions, sound effects, and synthetic voice outputs produced by your generation jobs and exported from the Services.

B. Full Commercial Rights

Subject to your continued compliance with these Terms, Flow AI Fx confirms that you hold 100% of the commercial rights to use, monetize, publish, broadcast, distribute, license, and sell Your Generated Content across commercial projects, client deliverables, social media, advertisements, cinema, and digital media worldwide. You remain solely responsible for ensuring your commercial usage complies with applicable third-party platform policies and local regulations.

C. Our Limited Operational License

You grant Flow AI Fx a worldwide, non-exclusive, royalty-free, limited license to host, store, copy, transcode, display, and process Your Input Content and Your Generated Content strictly for the following limited purposes:

Operating, maintaining, executing, and delivering the generative studio services to you (e.g., executing rendering pipelines, storing assets in your library, generating previews);
Monitoring and improving overall system stability, platform latency, and rendering performance solely in anonymized, de-identified, and aggregated form;
Displaying selected creations as public showcase examples in our marketing materials only if you provide explicit consent or make such assets publicly accessible.

D. Model Training Commitment

Flow AI Fx does not use your private uploaded reference assets or private generated outputs to train public foundation AI models, nor do we sell your creative files to third parties.

5. Subscriptions, Credits, and Billing

Pricing & Plans: Flow AI Fx offers tiered subscriptions (e.g., Pro Monthly, Pro Yearly) and optional credit refills as detailed on our Pricing page. All prices are in USD unless otherwise specified.
Credit System: Generation tasks consume computational credits proportional to the underlying model, duration, resolution, and processing complexity. Credits are deducted upon task submission.
Recurring Billing: Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date via your account settings or customer billing portal.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the conclusion of the current prepaid billing period; you retain access to plan benefits until the end of that cycle.
Refunds: All purchases and subscription fees are subject to our Refund Policy.

6. Flow AI Fx Intellectual Property

The Website, Services, proprietary user interface designs, logos, software, backend code, workflows, and platform documentation are the exclusive intellectual property of Flow AI Fx and its licensors. Except for the limited right to use the Services as expressly granted herein, no rights, titles, or interests in Flow AI Fx Intellectual Property are transferred to you.

7. User Feedback

If you provide suggestions, feature requests, bug reports, or other comments ("Feedback"), you grant Flow AI Fx a worldwide, perpetual, irrevocable, royalty-free license to use, implement, and commercialize such Feedback without any compensation, attribution, or accounting to you.

8. Customer Showcase and References

You agree that Flow AI Fx may display your public workspace username and publicly shared creations in marketing materials and customer showcases to identify you as a platform user. You may revoke this permission at any time by sending an email to support@flowaifx.app.

9. Modifications and Account Termination

Flow AI Fx reserves the right to modify or replace these Terms at any time. When material revisions occur, we will provide notice by updating the "Effective Date" at the top of this page or via in-app notification. Your continued use of the Services following the posting of modifications constitutes acceptance of the revised Terms.

We reserve the right to suspend or terminate your access to all or part of the Services at any time, with or without prior notice, for conduct that violates these Terms or harms other users or the platform. If Flow AI Fx terminates your active paid subscription without cause, we will issue a prorated refund for any prepaid, unexpired subscription period.

10. Disclaimer and Warranties

THE SERVICES AND ALL GENERATED OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, FLOW AI FX EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BECAUSE GENERATIVE AI MODELS OPERATE ON PROBABILISTIC ALGORITHMS, WE DO NOT WARRANT THAT:

GENERATED OUTPUTS WILL BE ACCURATE, UNINTERRUPTED, OR FREE FROM UNEXPECTED ARTIFACTS, DEFECTS, OR HALLUCINATIONS;
THE SERVICES WILL SATISFY YOUR SUBJECTIVE ARTISTIC EXPECTATIONS;
OUTPUTS WILL BE FULLY COMPATIBLE WITH EXTERNAL HARDWARE OR POST-PRODUCTION EDITING SUITES;
THE GENERATION SERVICE WILL BE PERMANENTLY ACCESSIBLE WITHOUT OCCASIONAL DOWNTIME OR MAINTENANCE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLOW AI FX, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, WORK STOPPAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO FLOW AI FX IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless Flow AI Fx, its affiliates, licensors, officers, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your access to or use of the Services;
Your violation of any provision of these Terms;
Your infringement of any third-party intellectual property, privacy, or publicity rights;
Your Input Content or Your Generated Content, including any claims alleging that assets created or uploaded by you infringe third-party rights or violate applicable laws.

13. Dispute Resolution and Governing Law

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through final and binding individual arbitration in accordance with standard commercial arbitration rules, rather than in court.

Class Action Waiver: YOU AND FLOW AI FX AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Flow AI Fx operates, without regard to conflict of law principles.
